While we all hear from the Title company about errors that Notaries made, I have to deal with errors they make.
The best example was I was hired by a Title company to take a deed of Trust to the courthouse for recording. I had done the closing (job # 1). The signer was getting a $25K cash out. Title would release the funds once the Deed was recorded. Taking care of the recording was my job # 2 with them. After I sent the original docs back to them, they sent the deed back to me to record. After I received the Deed back for recording, the fun started. The following errors were # 1 forgot to send exhibit A back, # 2 forgot to make sure that the name and address of the trustee was listed on the Deed (it was blank)(No one QC?). # 3 forgot to send a shipping label to return docs, and the best was # 4 forgot to include the check to the court house for the recording fees. (I've dealt with checks that were short, not missing before).
While the clerks are good, they don't except IOUs, no check no recording. Signer has now called title a number of times wanting his money. Do they want him to wait another day while they overnight a check or do I write the courthouse a check. I offered to do that for an additional fee (on top of my fee to take the deed for recording) plus the wire transfer fee charged by my bank. After they sent me a corrected page for the deed and the ex A I was able to get it recorded and the signer got money.
While Title complains about errors "we" make, you don't often hear about the errors they make. |
