House arrest is better than in jail. It's for non-serious but repeated crimes, like in this case DUI's so they can keep track and they cannot leave. I wouldn't worry about it, work as usual for me, but would have been a great conversation at the closing since he showed you his ankle monitor. I don't think it matters to the lender unless he is pending a lawsuit. I would still do the assignment and mention it in my completion notes to get paid in the least. I lived next door to work release center which is similar...never bothered me. They were out during the day, had to check in by dark.
