It seems to me making sure that all the documents use the same name as on the US Patriot Act form is a function performed while wearing your signing agent hat. Making sure the name on the document and notary certificate match and are supported by personal knowledge or satisfactory evidence is a notarial duty.
If two document that need notarization and are in the same package have different versions of the name, that's ok from a notary point of view if both names are supported by personal knowledge or satisfactory evidence. If one of these names doesn't agree with the Patriot Act form, it's the title company or lender's call about whether that's OK from their point of view. The Patriot Act only says the lender has to develop an ID policy; it doesn't say customers must always use exactly the same name on all forms. |
