On the Job Injury while serving as "representative"
Posted by Marilyn June Wilson of MS on 4/23/18 1:59pm Msg #592522
I recently accepted a Debt Resolution Presentation in a remote agricultural area of Mississippi. The signing order stated that I was being "hired" to serve as the law firm's "representative" and that I was not to refer to myself as "just a notary," but a "local representative of ABC Law Firm." I arrived at the location at 7:15 pm and it was dark. I used a flashlight and proceeded up the walkway to the front door. As I turned to face the house I move the light to the door area to verify the address, since the dwelling was dark. As I moved forward to go up the steps, I stepped into a huge crack in the walkway and fell forward on my face and kissed 3 concrete steps with my cheek, nose and mouth. I have 3 broken teeth, a fractured cheek bone and a fracture to the bone in my gum. The signed arrived as I returned to my vehicle to get a towel to stop the bleeding. The signer apologized profusely. I got bleeding under control, did the signing, and drove back 45 miles to a hospital near my home where I was seen in the ER. I contacted the signing company, and they very quickly stated that they had no liability, which I expected. However, when I called the law firm and spoke to the person's whose client I had seen for the signing stated very assuredly that the firm would take care of all my medical expenses just like they had done for another notary who was in an auto accident enroute to a signing for them. After several calls back to the person at the firm to find out how to file a claim, I received a call from him last week stating that I needed to stop calling. He is sorry I was injured, but there was nothing he could do to assist me. It would have to be handled by someone else. He would not even let me ask who I needed to contact.
Signer rents this house from his employer (farm owner). House is only covered by a fire policy. My only recourse seems to be the legal firm.
All this to ask: What steps should I take with the law firm?
