I have encountered differing scenarios over the years: 1. The borrower refuses to sign name differently. 2. The borrower has no knowledge that they are known by a different name and refuses to affirm this fact by signing. Throw in the fact that lender may not allow any changes and does not feel obligated to provide instructions to the signing agent saying as much, then the waters get murkier. The NSA ends up explaining that the incorrect names are not really his but they would like him to sign an affidavit saying that they are one and the same person. The best affidavits are the ones that show all of the different names in the text and the borrower signs the affidavit with his legal name as an understanding that he has been informed as to the alternate identities and that the lender must conform those names. Hint: one signature and one notarization. |
