I have done a Mortgage resigning before. I was told that the original Mortgage had been lost and therefore was never recorded. The title company discovered this through an audit of their escrow account that showed the check written for recording fees on the transaction had not cleared.
A notation was made on the Mortgage indicating it was a replacement for the lost original Mortgage. My acknowledgement showed the current date. |
