If you read the law quoted in your notary manual about acknowledgements (page 45) that the "A notary public or other officer completing..." box is in § 1189(a)(3), along with the rest of the California all-purpose acknowledgement. Paragraph (c) of that same § 1189 says
"(c) On documents to be fled in another state or jurisdiction of the United States, a California notary public may complete any acknowledgment form as may be required in that other state or jurisdiction on a document, provided the form does not require the notary to determine or certify that the signer holds a particular representative capacity or to make other determinations and certifcations not allowed by California law."
Since the box and the entire California all-purpose acknowledgement are all together in paragraph (a), I would think paragraph (c) is telling you the out-of-state form can replace both the box and the California all-purpose acknowledgement. |
