Guilty of what? I don't think you really understand how this all works. The prosecution has to PROVE both knowledge and intent. The law doesn't say anything at all about neglect, so what would he be guilty of? You don't get to make up your own crimes on the fly - that's not how our legal system works.

YES!!! Of course!! That's the whole point. If the law says there must be knowledge and intent, so and there is none, there is no crime. This is pretty basic stuff.
