If they "didn't know..." (and the DOJ buys it) then the very first element of 18 USC 1924 ("knowingly" removes documents...) is not able to be proven, and thus, they would not be able to be charged under 18 USC 1924.
I do find it difficult to believe that both, Biden and Pence, as politicians, are willing to take a chance on appearing to the public as if they are so careless and clueless regarding classified documents that they make the 'Pink Panther' look like a reliable professional who should be more trusted with State secrets than either of them. But I guess, given the alternative, they are willing to give it a try. LOL |
