I have no idea whether or not courts have ruled on whether or not HIPPA laws apply to situations where one person's health situation could potentially impact the health of others, as is the case with any contagion, including Covid-19. We have a long history in this country (and elsewhere) of vaccination requirements, including school attendance, travel to certain places, etc. I do think, however, that's it's likely this issue will end up being ruled on by some court somewhere before too long.
Personally, I don't believe HIPPA laws had this type of thing in mind when they were created. As for discrimination, our freedoms in many areas end when they potentially have a direct impact on the health and safety of others. |
