I wonder what Jack/AL's reasoning is for "it as illegal for her to ask that I do so"? I know CA has a law saying it's illegal to knowingly ask a notary to perform an illegal notarization, but I wonder what law would make it illegal elsewhere.
I think a law of this sort is unenforceable. Let's say a notary produced an email exchange showing that someone had emailed, asking for an illegal notarial act. The notary replies, explaining it's illegal and it's illegal to ask. Then there is another email where the illegal request is repeated. When challenged, the person who made the illegal request could just say "Sure, that notary emailed me, claiming my request was illegal, but I didn't believe him. I know now the request was illegal, but at the time, I thought that notary was full of horsefeathers." |
