I don't believe that reasoning would fly because we're talking about something very easily verifiable. If someone - particularly someone in our industry - doesn't believe the notary, all they have to do is go online, pull up the state notary handbook and check it out. It's all there in black and white.
I do think you may have a point that it's not terribly likely to be enforced. However... imagine someone trying to tell a judge that they didn't think the duly commissioned notary public was credible when they refused to carry out an illegal act when requested, and then informed the requester that making that request was also against the law. I'd love to be a fly on the wall for THAT conversation!  |
