"(j) Failure to complete the acknowledgment at the time the notary' s signature and seal are affixed to the document."
That has been part of CA notary law for at least the 14 years I've been a notary. To me, this is simply stating that we cannot sign or affix our seal to a certificate until we complete the notary certificate in full. This doesn't refer in any way to the presence of the borrower.
Again, just to be clear, I'm NOT advocating that certificates be completed later. I think it's poor procedure and I would want to see the notarizations completed in front of me for any document I needed notarized. (How can you record the time of the notarization(s) with any degree of accuracy?) However, let's also be accurate in our claims about what is good policy, what is "recommended", and what is an actual legal requirement.
