I asked about if what we did as a NSA feel under the requirement and this was the answer I got -
Thank you for your inquiry. Notaries or “Witness Only” Closers are only authorized to verify the identities and signatures of individuals. A “CRESPA” now RESA certified individual must be title licensed and registered to conduct settlements on Virginia property. RESA registered individuals must obtain the necessary insurance documents which include a surety bond , e&o coverage and Fidelity Bond (if applicable). Notaries are not permissible to handle funds associated with a settlement regardless if the funds are not made out to them as you describe below. What you described below is a violation of the Code of Virginia and can be deemed unlicensed and un-registered activity. Please visit the RESA website to being licensed and registered.
