You are correct, no listed agency is responsible for your payment EXCEPT when the contract has NOT been honored and payment(s) not received for service(s) rendered. Once the contract has been breached then you have the OPTION to report to said agencies, commissions, associations, & law enforcement. . The list is a tool if someone feels that they were scammed out of their hard earned monies and would like to report them to authorities. Remember notaries are a “third party vendor” to a Real Estate transaction when conducting a signing.
To answer your question of “why contact”. On the “list” there are footnotes saying BBB is “not an enforcement agency.” Also, the other footnote, only contact the Realtor “if applicable”. Not all loans have a Real Estate Agent involved. Hence, the term used “if applicable.” Hope this clears up the confusion. Of course when contacting agencies and/or hiring parties ALWAYS be professional! Never use foul language or emotion. State the facts only. That was a very good point you brought up. Lawsuit?? You have the confirmation, signed off on website or email trail, copy of shipping label (tracks docs sent), documents recorded with your notary seal. On what grounds?
It seems many notaries have been bullied and scared into not reporting this epidemic of non-paying Signing Services. It is the industries dirty little secret. I find it very hard to believe that letting Title or Escrow know one of their vendors is not paying their notaries for a perfectly executed signing would burn a bridge? A normal company/person would be more upset with the non-paying vendor and correct the situation. There are several GREAT Signing Services that would love the business.
