Notarization for blind signer
Posted by  NJW/FL of FL on 4/20/17 11:01am Msg #573958
I accepted a signing for a refi where the third party on documents (vested interest) not on loan is blind, in a nursing home and would be signing with a mark. Florida statutes state that the notary must read the entire document to the blind signer before notarizing. That, of course, means that I would have to read the entire mortgage and the affidavits that she is required to sign. The fee would certainly not cover the time involved for this. I was also leery of whether or not she would be mentally competent to sign as I encounter this in my general notary work. This was not disclosed when I accepted the assignment and I ended up turning it back as it was a significant distance and I would not know until I met her if she was competent. I had to make the decision quickly once I gave the details to the title company when I spoke with him. I would appreciate input on anyone who has been in this situation involving a loan signing. Thank you.
