The way I see it, the person exercising their authority as AIF should be signing both names whenever exercising that authority, so it would be obvious to whomever is accepting the doc that a POA was used. It's the receiver's responsibility to verify the validity of the POA and that signature.
If someone wanted to simply sign the principle's name without including their own (i.e 'John Doe' vs. 'John Doe by Mary Doe, as his AIF'), then I'd be concerned. That could be a potential forgery.
As previously stated, this is very consistent with the CA prohibition on certifying capacity. |
