Jacob is an IC.....he's available when he wants to be. I see no "dilemma".

Agree with Yoli....Jacob is (or should say he's) "booked" for the afternoon/evening and refer the callers to notary colleagues who may be available.

Tell the truth? None of anyone's business what he's actually doing at any moment of a call. If he's not available, whether it's happy hour, recovering from knee surgery, on vacation, in the dentist's chair, at the car wash, walking the dog, at a ballgame, sitting on his front porch counting blue cars that pass, watching grass grow or paint dry, etc.......the blanket answer should always be, "I'm BOOKED at that time, would you like a referral to a notary colleague?" He could also ask the scheduler if the borrowers are flexible as he's available at X date, and X time to meet with the borrowers. Sometimes, the appt set by the TC is not written in stone and the borrowers may be very flexible. It may work out (where docs aren't date sensitive) that the notary and borrower could meet the next morning. Doesn't hurt to ask if borrowers are flexible.
But never should an NSA explain himself regarding his/her availability....he/she is "booked" if not available....nobody's business why the NSA is not available. JMHO
