… mental health experts, we are not qualified to determine "full mental capacity." Nowhere in any notary handbook does it says that is our responsibility. Determining "full mental capacity" (whatever that is) is best left to those who know what it means and how to accurately diagnose it.

We do, however, assess willingness to sign based on signer's knowledge of documents. All we can do without getting ourselves in trouble is exactly what you said toward the end of your post: "that he understands what he is signing." He may act completely looney (how many borrowers have we signed that might fit that description?) Only difference is they aren't necessarily deaf, illiterate and blind in one eye and have to have the docs read to them, so they don't attract the attention your guy does.

You didn't say what kind of docs he's signing. I've been in a few marginal situations where it's looking like family members are forcing the old guy or the anxious mother into signing something that will benefit them and not the signer and had to deal with that. It's a tough situation to be in.
