mortgages - only deeds of conveyance - now if Florida used a Mortgage "Deed" (like CT) then yes it would follow the letter of the law and witnesses would be required but, apparently, under this law, there is no conveyance with a Mortgage so not required.
However, that said, some counties have imposed their own regulations as far as witness requirements are concerned = Dixie County started it first due to rampant real estate fraud in the county - some other local counties around here followed suit - Suwannee for one.
Like I said - IMO it's easier to just get witnesses than to argue about it - having them doesn't render it unrecordable - not having them, or only having it witnessed by one when two are required, WILL get that Mortgage kicked back |
