How a person signs (with or without the stated capacity) can be different from what is included in the notarial certificate. If a person signs "John Q Public" and the signature line shows the name as "John Q Public, Trustee" how the notarial certificate is completed depends on the state the document is being signed in.
In CA, your laws do not allow the inclusion of the capacity in your certificate.
In FL, the laws provide specific guidelines and a format for the certificate that includes the claimed capacity. Even if the signer signs only their name without the title, the information typed under the signature line dictates the inclusion of the stated capacity in the certificate. There is no need to add an additional page to a document, we just add the prescribed verbiage to the certificate that was provided. |
