I'm pretty sure (as you probably are, too) that this isn't the same as a 1031. It's been mentioned here before (at least once), but a very superficial search of this site didn't bring up that thread. A Google search mostly brings up the topic in relation to a type of stock purchase agreement, but that's also a different beast - although this option might have been an outgrowth of that concept. My impression was that it's a new creative method for some entities (lenders?, investors?) to generate some kind of business in this stalled market, by locking in a future transaction.
Hopefully we'll hear from someone else who's seen one, or perhaps even better, also works in loan origination and has had some training on those. I just remember thinking that it sounded like a pretty risky option, but that might be a good deal for the right (sophisticated?, desperate?) property owner.
Can you enlighten us on who the players were, i.e the category of party that was originating the Agreement?
