This is too twisted for color TV, and one almost needs to be Harvey the rabbit to follow down this hole.
Revisiting both your posts, most of us here can probably identify at least two things:
1. "It says it is not a loan", and "it appears as though she is agreeing to pay them any increase in value of her home in the future if she sells", screams out an Equity Share 'Investment' as those companies like to call them.
2. "She is in fact remaining in the property and receiving funds, cash out. She is not moving so it is not a "sale" as of yet."
What you're saying is it doesn't appear she is planning on relinquishing (selling) it as part of a 1031 exchange. Okay, I can buy that, based on what appears to already be an equity share transaction instead.
I took a few other routes of thinking but feel I'm following the right rabbit down the right rabbit hole here. Hang on...
That leaves this big question:
Why is an equity share company using a 'Forward Sale and Exchange Agreement' on an equity-share-investment transaction?
