Some states have their own regulations. If in doubt, call the title company on the order and ask them. Many years ago I was instructed by a title company to use blue ink on the documents.
A week later I was contacted by them saying that I had to go back and re-sign the 150-page package on my own dime because the office at the county refused to record the mortgage because they require black ink be used and the lender requires all be signed in the same color of ink. I told them that the instructions they gave me said blue ink and they replied no we didn't.
Luckily I save ALL confirmations and was able to scan it back to them. I promptly got a phone call stating that I would get FULL payment for both signings. Taught me a huge lesson. First: If in doubt, call. Second: Keep printed copies of every confirmation for each closing.
If for some reason the lender wants documents to be signed in one color and the property address is in a state that requires opposite, I have the signers sign the recorded documents first, then go back and start at the beginning of the package with the lender-required color.
