Sounds like things got a little off track here somewhere. A California Ack certificate does not use the word "representative" anywhere. It simply states that the signer "acknowledged to me that he/she/they executed the same in his/her/their authorized capacity(ies)..."
That 'authorized capacity' usually refers to the signer himself/herself as an individual, so I don't see that implying any representation. In fact, an actual representative capacity is *prohibited* from being included in a CA Ack certificate (e.g. Trustee, CEO, etc.), as quoted by Yoli above. Perhaps the wording leaves room for improvement in terms of clarity, but that's the common understanding here. |
