Here's what I read:
The son ASKS ME WHERE IN THE LAW does it state . . . I directed him to the SOS website, where he could find the notary public handbook and search the PDF for "COERCION".

He then asked WHAT KIND OF ACTION can be taken against that notary for agreeing to do a notarization for someone who doesn't even know what day it is, and clearly has DISREGARDED HER DUTIES as a disinterested third party who is present to verify the cognizance and awareness of the person who is signing. **I told him he can locate this in the HANDBOOK also.**

We have knowledge, experience and familiarity with situations; that doesn't make us legal gurus, or even experts (Ms. C never claimed she was). We also know where our duties and boundaries lie (lay?) which is why we gladly refer a requestor to the resources that we know will benefit him/her the most (that what was done).

And when we are put in the Hot seat (like the notary in the title transfer situation) and don't like the way it feels we may REFUSE to notarize (in VA) for reasons nicely put by VT/Syrup. Whether or not I've "disregarded my duties" is for no one else to decide - except my SOC and my conscience; however once my signature and seal hits the surface of the document, then only a court can judge.


(And no, there was NO bashing of anyone or any entity - just our individual opinions, commentary, etc. which obviously will differ).
