I am not going to address anything except the nonpayment and the $10.00 deduction for the signing --
You say that you have not been paid, although you were originally paid for the signing. It is not this woman's fault that the check was lost, regardless of the fact that the loss was no fault of your own. If is also not the woman's fault that the bank will not honor the check because I'm assuming it is over 90 days.
You don't agree that the woman is entitled to receive a fee for reissuing a duplicate check. I disagree. Back to my first point -- she originally paid you, and regardless of what you think, she *will* be out her time to issue another check. IMO, $10.00 is a cheap fee that you are responsible for -- stop payment fees at the bank average $35.00 and it takes very little time for the bank to put the alert on your account.
Take her to Small Claims and I can almost assure you she is entitled to the $10.00 fee. |
