You may have whatever issue you have. It's not a 3 year old check. The attorney post there indicated that when there is a sum owed, it's owed. So I'm not sure who you're quoting, the laypersons? The attorney stated the following:
"If the bank dishonors the check (as it likely will on a check that is 3 years old), you still have recourse against the person who wrote the check because you've not yet been paid and that person's obligation is not yet discharged. You would, of course, have to bring your claim within the applicable statute of limitation. If the business is in Maryland, the statute of limitations is likely 3 years here. So, if you are going to sue to get the full refund, you'd better not wait much longer to do it."
As far as your issue, it's your issue.
