Not a CA notary, but a person's name appearing twice in acknowledgement or having two acknowledgement blocks for the same person is common in my world. Not saying it's the best or only way to go, but many investment companies, attorneys, "legal department" QC nitpickers want it this way or REJECTION.
Person signing signs 1) in his/her capacity as an individual and 2) in his/her capacity as a Trustee (even seen it as Executor) or deed referred to has Betty P. Fence and when Betty P. Fence set up her trust she decided to use "Betty Privacy Fence" for her name; i.e., same person using different names at different times.
Notarization block as person acknowledging signature 1) as an individual and 2) in his/her capacity as Trustee or to acknowledge ONE person identified in documents using two different forms of his/her name. (Investment company wanted all bases covered - lawyers were, "fine, if this it what it takes for the investment company to accept the documents, 'just do it.' No law stating it cannot be done that way." I GUESS California has something about "capacity" cannot be included in a notarization block; CT and FL do not.)
Just did one Friday: Signed and acknowledged as a person and as a Trustee for deeds, affidavits and Trust documents signed in CT on documents being used in FL for changes to Trust and real estate. Person took title with to real estate and current bank accounts as Betty P. Fence; Trust documents and investment account established with full name - Betty Privacy Fence. Trust me, after dealing with the paperwork and bureaucratic QC mess, Betty Privacy Fence will be using her full name on everything |
