Re: Very common in Trusts & Estates world ..

<<<I GUESS California has something about "capacity" cannot be included in a notarization block;....>>>

Bingo!!! ONE CA Ack (or Jurat) cannot cover variations of the same person on the same cert, as in:

On Jan.7, 2017, before me, Jane E. Doe, Notary Public, personally appeared Mary Beth Smith, Mary B. Smith,
M. Beth Smith, Mary Smith, M. Smith, and M.B. Smith, who proved to me on the basis of satisfactory evidence to be the person(s) whose name(s) is/are subscribed to the within instrument.....etc.

Separate certs for each name variation is required in CA if the entity wants all name variation signatures notarized for their package. Contents have no bearing on the CA notary, except that it's complete (all pages included), there are no blanks, and no falsehoods. Falsehoods are discovered when the client blabs that there are. What's great about handling 95% GNW are the nuances and gray areas of notarizing that notaries who handle primarily loans signings or a few hospital appts notarizing POAs or healthcare directives don't experience. I get the federal gov't docs with "NO OTHER NOTARY ACKNOWLEDGMENT WILL BE ACCEPTED" in bold print with a non-compliant cert and no room for the notary seal. I get the docs where the customer has no clue what the entity wants yet there's no contact number to get direction. There is no lender, TC, LO, or escrow officer to call and get guidance as there are with loan signings. There's no attorney's office to call regarding Trust/Estate docs. There's no rescheduling the appt to reprint the package. There are no additional copies to switch out if errors are made in signing.

I have to decide *on the spot* if a notarization is a GO or a NO. I often have to explain to the signer why I must follow notary law in spite of what the entity demands and tell the signer to give the entity my number directly if they reject the doc. For those who believe GNW is simple and a piece of cake, most of the time it is. But quite often, it's not which is why I don't get caught up in what's common in these "worlds" (i.e. trust, estate, or commercial loan docs). Notary law applies to ALL notarizations, whether the entity agrees with it or likes it.
