Was This A Purchase Signing?

Please don't be upset with me when I share my opinion with you . . . but I hope you and other closers can use this as a learning experience if it ever comes up again.

Was this a purchase signing or an investment property refinance that needed to fund the same day? If so, the title company needed those back right away after you were finished signing them in order to fund the loan. The instructions clearly stated that you were to fax back immediately. You are the one that assumed you had a window of 2-4 hours. There might be other title companies/signing companies that give you a 2-4 hour window based on certain assignments, but clearly you did not have it on this one based on the fact that you were facilitating a transaction that had same day funding. There have been times when I have been instructed to fax back from the table and wait for funding authorization for purchase transactions before I can move on to my next appointment.

Every appointment you accept is different in what it entails and it is your responsibility to make sure you can meet the criteria that is expected before you accept that assignment. This assignment required you to do fax backs immediately and you did not follow through with what was expected of you. I get it that you spent a lot of time driving and printing documents, but you did not complete the assignment you were hired to do, thus not allowing the loan to be funded same day as was required. You booked yourself too tight with the types of closings you were taking.

In your defense, you had a purchase closing at 2:00 p.m. EST that needed to fund the same day. The title company was cutting it pretty close expecting you to finish the closing in time for you to still fax back the documents and for them to still get it funded the same day. Even if you did not have another closing after your closing for ASAP Pro Notary, it would have been cutting it pretty close since you didn't even finish the closing until 3:45 p.m. and you were going to have to drive home 1 hour (in rush hour traffic) to get it on the fax machine in time for the title company to have it. Best case scenario they would not get it until after 5:00 p.m. anyway.

Was April at ASAP Pro Notary aware of all this when she hired you for the closing? Was she aware of how close it would be cutting it since the closing was happening so late in the day? Did she make you aware of all of this before sending you out on this assignment?

Communication between you and your hiring party is the key here. Once you were aware of the challenges you were facing, you should have let April know that there was no way possible they would get anything in their hands before 5:00 p.m. and ask if that would be acceptable. Chances are that once the title company was made aware of that, they would have realized there was no way it was going to be able to fund same day unless someone stayed late to do it and it would not have been a problem.
