IMO, there are some additional lessons to be learned here, specifically:

1. Always check SC, even if after the fact. And if it's an iffy company with 1 or 2 stars, turn it back.
2. Get clarification of scope of work up front, especially for purchase/sale transactions. If you get docs or additional instructions that change scope of work, communicate with your client asap and redo agreement.

If a purchase is involved, make sure you know when they need docs back. I've done many that didn't need docs scanned back immediately, but there's always the expectation that it's going to be very soon. Take responsibility for that and be accountable.

As for this comment: "I sent the documents this morning because I missed the drop last night..."

First, I'm still chewing on the perspective that once they say they're not going to pay you that the agreement for the signing is moot and you don't need to return the docs. On principle, I have a problem with this because I believe problems should be figured out up front and that if you're dealing with a reputable company, things can be worked out. Once you've taken up the borrowers' time and completed the scheduled signing, there's may be serious liability involved if you don't follow through. I'm not saying this is right and I'm no attorney, but it's an important consideration.

Secondly, this is where you lost any sympathy from me. It's one thing not getting the fax/scan done as expected, but then also missing the drop? If I'm understanding this correctly, that means a two-day delay in title getting the documents. This could be an extremely costly delay. As someone else said, be happy if they don't go after your E&O. And I think you're also going to have a very hard time getting any sympathy from the title co. (However, they should absolutely know the kind of company they're doing business with.)

Two wrongs don't make a right. Their lack of professionalism doesn't excuse yours. If you're not going to complete what they expect for what they've agreed to pay, let them know up front. If they change the terms, let them know whether or not you can still do all aspects of the job and if not, let it go. If you learn that there's a chance you may not get paid even if you do what they expect, turn it back. THAT'S a significant part of what it means to be a professional in our business.

As I've said many times before, if companies like this one get enough assignments turned back and have a difficult time filling them, title companies will have to go look for another ss to hire notaries - or better yet - do it themselves. They have a decision to make about what level of service they want to provide to their borrowers and sellers, as well. Our responsibility is to make sure that we do our professional best when the good companies DO get the business. Let's make sure they can be confident that it's worth it to them to pay a little more to have all their work done right - and on time.
