As to holding docs hostage ...
Posted by BearPaw/CO of CO on 4/20/17 2:30pm Msg #573976
I acknowledge the outcry from notable NSAs about never holding docs "for spite." That would be unacceptable. However, ASAP already told you they're not paying you. So the deal is off. Not sending docs back has nothing to do with ransom in this case. Like LD said, docs are mute. Everybody's sympathizing with the borrowers. Boo hoo. It's not our job to be Dr. Feel Good. It's up to title company to hire a reputable SS (they should know only losers work for ASAP Pro Notary). So the title company got what it deserved. As much as some lofty NSAs would like to think otherwise, there is nothing sacred or holy about a sign-up. It's a business deal between us and a hiring agency. Your performance was not acceptable to title or the SS, so they withdrew their offer midstream; the deal was dead at that point, and that includes any signed docs. They're collateral damage. These things work both ways; it's a two-way street. They're not paying you for "your work." What work? Work just evaporated. Granted, borrowers signed docs, thinking they had a contract. However, there's a middleman in all this: the notary. And it's understood that the notary will get paid for their role in the transaction. If in the middle of things, the notary is told the deal is dead, so are the docs. (Of course, this is just chatter for thought since you did drop docs eventually.)

The main problem here is that you took a job with ASAP Pro Notary, one of the leading slime balls of the industry. You wrote: <<I am upset that I didnt take the time to read about this company ASAP PRO NOTARY.>> You're upset? I'm really upset Then, you totally screw up the signing (late/botched faxbacks, missed drop off, making assumptions, on and on.) But the WORST part is that after things completely fell apart, you come on NR, whining and expecting sympathy from your fellow NSAs when all you have done is your very best to keep a lousy SS in business. Did you think you're special, you're different? And that ASAP would fall all over itself to pay you when they don't pay anyone else? Even for jobs well done? As long as in your little world you cared only for yourself, forgetting the hundreds of notaries this outfit has stiffed? That's all that mattered? LD was absolutely spot-on in every post she made in this thread. You never would have been paid anyway, even if you hadn't screwed everything up. And regarding your post where you listed "what you learned": the fact is that the one and only point you needed to have made is NEVER work for a jerkoff outfit like ASAP. You had PLENTY of opportunity to turn this back. You deserve everything you got. And using Snapdocs is adding insult on injury, just as Cari and Christine said. It's notaries like you, well ... just think about your role in this catastrophe.

Another point: It's highly unlikely that ASAP got paid for this job from title. They knew from the getgo that title wouldn't pay in a case of massive notary error or even a little bitty notary error. So they made a preemptive strike ... against you. That's just the way it is and for you to expect payment at this point from a well-known house of cheat is pretty ludicrous. You're lucky they're not coming after your E&O.

Full disclaimer: This is all jmo because I have never been in the position as described by OP.
