The lender and title company don't want their dates changed on any documents. 1. DOT is dated 2/3/18. If one signer signs today (of course my certificate would have today's date!) but I can promise you the DOT will be sent back as "not recordable" because one signer signed prior to the date of the document while the other signer signed on that date. 2. The NORTC is dated 2/3/18 with an expiration of 2/7/18 at 12 midnight. If signer is signing today 1/31/18 her rescission period is effectively changed. Thus her right to cancel now expires 2/3/18!
If lender and title will NOT allow pre-printed dates to be changed and initialed for just this one signer then basically her rights to cancel are not the same as second signer.
3. I have gone back out on signing appointments over the years to re-do a DOT that was signed prior the the pre-printed date on it that other notaries public executed. The county recorders office rejected it and said they could not record the document. Based on this experience it is prudent for me to question and request to change dates only where necessary, initial and have signer #1 sign the package and then ship to Nevada to second signer/notary public for final completion. |
