So far, it looks like the verdict is unanimous and everyone who has posted disagrees with you. I'm not aware of any statute here in CA or elsewhere that addresses the document creation or effective date. As an NSA, our responsibilities regarding dates on documents are essentially limited to two things (unless specifically instructed that they're date-sensitive). The first is that the date on our notary certificates is correct. The second is that the RTC period allows for a MINIMUM of three business days for each signer - and with some lenders, they might not be the same three days, if it's a split signing. Other lenders will just extend the rescission period for the first signer so they end on the same date, just to keep it simple.
It's understandable that you'd come to the conclusion you did because of the situation you had with the County Recorder's office, but we need to always be aware that their staff can make mistakes, too. That's just one more reason for us to be certain to be on top of our state's notary laws.
