suggestion is best IMO. I've encountered situations like this too, where the notary didn't properly notarize a POA. There isn't always an opportunity to have it re-done. This really gets me too, that notaries are out there handling critical legal documents that they shouldn't touch if they don't know what they're doing. I'm sorry for your situation. IMO Guardianship is the better option because of the dementia. Talk with his Dr. about how to proceed with that because it usually requires a Dr. to state that the person is totally incapacitated. |
