I have a scenario where a Proof of Execution by Subscribing Witness is needed. Flying out same day, etc. Does anyone know if it is acceptable (provided signed on same day) to use a Proof of Execution by Subscribing Witness for a form DS3503 (Statement of Consent for Issuing a Passport to a Child) https://eforms.state.gov/Forms/ds3053.pdf ? I take great caution with this because it is a Federal Form requiring notarization, so my first instinct was to say 'No', which I did.
However, after further research this form is not conjunction with any power of attorney, quitclaim deed, grant deed (other than a trustee’s deed or deed of reconveyance), mortgage, deed of trust, security agreement, or any instrument requiring a notary public to obtain a thumbprint from the party signing the document in my journal. This leads me to believe it may be allowed.
Does anyone have thoughts or experience with this?
