I have been a CA notary for 56+ years. I've never been asked for a Proof of Execution by Subscribing Witness. Generally, it is used in business scenarios, i.e., Johnny Depp wants something notarized but his private jet is leaving for his Italian villa and he asks his assistant to get it notarized, having nothing to do with trust documents or real estate documents. He has given POA to his business manager to act in his behalf on those kinds of documents. BTW, this question came up when I taught notary classes, and the scenario was described to the class by a student who worked for an artist talent agency representing high profile actors.
This scenario may be on a proctored exam for a notary commission, but it is not widely used by 99 percent off notaries, I assure you. We need to know about it and get it right on the exam hopefully.
It looks kosher to me, I would do it if asked for your described purpose. |
